Divorce
Divorce cases are common throughout the United State of America but the process can be complicated because divorce also opens some new chapters like child custody, child support, visitation, ad property division, etc. The marriage can be dissolved by following three ways.
1. Legal separation
Legal separation allows both spouses to live apart but they remain legally married. This separation is helpful for the spouses while they are working for divorce.
2. Divorce
Divorce is done on the ground of some faults. One spouse has to file the case against the other. The issues like child custody, support, visitation, and property division issues need to be solved.
3. Dissolution
This type of divorce is done on no-fault grounds. Both the spouses agree on divorce issues like child custody/support, visitation, and property division.
Distribution of property
Property division can become complicated for the spouse seeking a divorce. This complication is due to the common idea that all marital property is divided as a 50% share of each spouse. This is not true in all states of the United States of America. The court takes many factors into the consideration before dividing the marital property. So, hiring a family law attorney will legally support your case.
Marriage License
If you are living in Ohio and wanted to get married then get a marriage license first. After getting a license, the married couple will be entitled to all rights and privileges which avail all married people. There are some requirements to get this marriage license. For example:
- Both parties will appear in the probable court in one of the districts where they live.
- A couple 16-18 years of age must get parent or guardian consent and proof of marriage counseling.
- Couples cannot be the parent and child, sibling, uncle/aunt, niece/nephew, or first cousins.
- The couple should not be married at the time of getting a license. The court will ask about the divorce certificate if one spouse was married before. A death certificate is not needed.
So, family laws involve many steps and legal limitations which are not known by the majority of the people. So, hire a family law attorney to solve all the cases related to family law.
